Contract Disputes

Contract disputes are very common occurrences that unfortunately touch many aspects of life.  When a party to a contract fails to abide by the terms of the agreement, whether it is an oral agreement or a written one, that person is considered to be in breach of the contract.  Depending upon the language of the contract and the course of dealings between the parties, there are various ways to resolve a breach of contract dispute.  Many times, the best route is for the parties to try to work out the dispute through settlement negotiations in order to avoid the need for court intervention.  Nevertheless, there are other times when the parties cannot or will not settle the dispute through friendly negotiations, and the best route is to file a complaint and initiate the formal litigation process.  Alternatively, the parties can elect or the contract may specify that the dispute must be settled through an alternative dispute resolution (ADR) process, such as mediation or arbitration.
